By accessing this website, booking, or participating in any programme, stay, event, gathering, experience, or using any services provided by Terra Rosa Productions S.L. (“Terra Rosa”, “we”, “our”, or “us”), you (“Guest”, “Participant”, or “User”) acknowledge that you have read, understood, and agree to be legally bound by these Terms, Privacy, Cookies, and Legal Policies. If you do not agree, you must refrain from using the website or participating in any Programme, Stay, Event, Gathering, or Experience.
1. Definitions
For purposes of these Terms:

“Terra Rosa” refers to Terra Rosa Productions S.L., including all subsidiaries, affiliates, employees, contractors, and legal representatives.

“Guest”, “Participant”, or “User” refers to any individual accessing the Terra Rosa website, booking, attending, or participating in any Programme, Stay, Event, Gathering, or Experience.

“Programme”, “Event”, “Stay”, “Gathering”, or “Experience” refers to any activity, service, accommodation, class, workshop, or retreat provided by Terra Rosa.

“Services” refers collectively to all Programmes, Stays, Events, Gatherings, Experiences, accommodations, meals, classes, workshops, and associated facilities provided by Terra Rosa.

“Website” refers to www.terrarosa.com, including all subdomains, mobile applications, and other digital platforms operated by Terra Rosa.
2. Booking, Payment, and Admission
All bookings require payment of a non-refundable deposit of no less than fifty percent (50%) of the total Programme/Stay/Event cost to secure a reservation. Full payment must be received by the deadlines specified at the time of booking; failure to make timely payment constitutes a material breach of contract, and Terra Rosa reserves the right to cancel bookings without liability.
Terra Rosa may refuse admission or deny participation to any Guest at its sole discretion. All payments must be made through approved platforms, including but not limited to Stripe, PayPal, or bank transfer. Terra Rosa is not responsible for errors or delays arising from third-party payment processors or banking issues.
Check-in is generally at 15:00, and check-out is at 10:00. Early check-in or late check-out requires prior written approval and may incur additional charges. Terra Rosa reserves the right to set minimum stay periods and the booking Guest remains financially liable for all unused beds, meals, or Services if minimum participation is not met.
3. Guest Conduct, Obligations, and Safety Rules
Guests must act lawfully, respectfully, and in a manner that does not disturb or endanger others or property. Guests shall not bring alcohol, illegal substances, weapons, or hazardous materials onto the property. Guests are responsible for their belongings and any damage caused through negligence or misconduct. Terra Rosa reserves the right to recover full repair or replacement costs and to remove Guests without refund. Any violation constitutes a material breach and may result in removal at the Guest’s expense, as well as potential legal liability. Guests must comply with all Spanish laws and follow Terra Rosa’s safety and emergency protocols. Failure to do so may result in removal and liability for damages.
4. Cancellation, Refunds, Rescheduling, and Force Majeure
Cancellation and Refund Policy

6 months or more before the start date: Full refund, minus a €200 administrative fee.

3 to 6 months before the start date: 50% refund, minus a €200 administrative fee.

1 to 3 months before the start date: 25% refund, minus a €200 administrative fee.

Less than 2 weeks before the start date: No refund, except in documented exceptional circumstances
Exceptional circumstances include death in the family, hospitalization, natural disasters, war, pandemics, or government restrictions. Transfers or deferrals may be granted at Terra Rosa’s discretion. Terra Rosa may reschedule or cancel any Programme due to force majeure, low participation, or safety concerns. Refunds will cover fees paid but exclude non-refundable third-party costs (flights, visas, insurance, etc.).
In all cases where a refund is granted, a €200 administrative fee will be retained by Terra Rosa Productions S.L.
5. Assumption of Risk, Liability, and Insurance
Participation involves inherent risks, including physical, emotional, and environmental hazards. Guests assume full responsibility for their safety and property. Terra Rosa is not liable for injury, illness, death, loss, or damage arising from environmental conditions, acts of third parties, or Guest actions.
Guests are strongly advised to maintain valid travel, health, and liability insurance. Guests agree to indemnify and hold harmless Terra Rosa, its affiliates, officers, and agents from any claims or damages arising from participation or breach of these Terms.
6. Health, Fire, and Emergency Procedures
Guests must comply with all health and safety instructions. Fires, candles, fireworks, or any form of open flame are strictly prohibited. Any hazards, unsafe conditions, or injuries must be reported immediately. Non-compliance may result in removal and potential legal consequences.
7. Privacy, Data Protection, and GDPR Compliance
Terra Rosa collects and processes personal data for booking, payment, communication, marketing, and compliance purposes, in accordance with GDPR and the Spanish LOPDGDD. Guests may exercise their rights to access, rectify, delete, restrict, or port their data, withdraw marketing consent, or lodge complaints with the Agencia Española de Protección de Datos (AEPD).
8. Cookies Policy
The Terra Rosa website uses cookies for essential, analytical, and marketing purposes. Guests may disable cookies via browser settings, though this may limit site functionality.
9. Intellectual Property
All website and programme content - including text, images, graphics, and media - is the property of Terra Rosa Productions S.L. Unauthorized reproduction or commercial use is strictly prohibited.
10. Governing Law, Jurisdiction, and Dispute Resolution
These Terms are governed by Spanish law. All disputes shall be resolved exclusively in the competent courts of Spain. Guests waive any right to challenge jurisdiction or venue.
11. Limitation of Liability
Terra Rosa shall not be liable for any indirect, incidental, consequential, punitive, or exemplary damages. In no event shall Terra Rosa’s total aggregate liability exceed the total amount paid by the Guest for the specific Programme, Stay, or Event giving rise to the claim.
12. Medical Conditions and Fitness to Participate
Guests are responsible for ensuring they are physically and mentally fit to participate. By attending, Guests confirm they have disclosed any relevant medical conditions. Terra Rosa reserves the right to refuse participation or require medical clearance for safety reasons. Participation under the influence of drugs or alcohol is prohibited.
13. Media, Photography, and Content Use
Unless otherwise stated in writing, Guests grant Terra Rosa a perpetual, worldwide, royalty-free license to use photographs, videos, or media captured during any Programme or Event for promotional and documentation purposes. Guests who wish to opt out must notify Terra Rosa in writing before the start of the Programme.
14. Property and Facilities Disclaimer
Guests acknowledge that Terra Rosa operates in natural environments that may involve uneven terrain, wildlife, insects, and other inherent risks. Terra Rosa shall not be liable for any injuries or damages arising from such conditions or from failure to follow safety instructions.
15. Complaints and Resolution Procedure
Any complaint must be submitted in writing within seven (7) days of the incident or end of the stay. Failure to do so releases Terra Rosa from any liability related to that complaint. Terra Rosa will review and respond in good faith.
16. Modifications to Terms
Terra Rosa may amend or update these Terms at any time. The most recent version published on the official website supersedes all prior versions. Continued participation constitutes acceptance of updated Terms.
17. Severability and Entire Agreement
If any provision is found invalid or unenforceable, the remaining provisions remain in full force. These Terms represent the entire agreement between Terra Rosa and the Guest, superseding any prior communications.
18. Language
These Terms are drafted in English. In case of translation discrepancies, the English version shall prevail.
